Our Services
Brooklyn Beach Design LLC is a web design and digital marketing agency based in Palm Desert, California. We provide website design and development, social media management, digital advertising, and reputation management services. The specific scope, timeline, and fees for any engagement are defined in a separate written proposal or agreement. These Terms govern your use of our website and your general relationship with us; where a signed agreement conflicts with these Terms, the signed agreement controls.
Client Responsibilities
You agree to provide accurate information, supply requested materials and approvals in a timely manner, and confirm that you own or have the rights to any content, images, or trademarks you provide to us. You are responsible for the lawful use of any website or service we deliver or manage on your behalf.
Proposals and Agreements
Project-specific terms — including scope, deliverables, timelines, and fees — are set out in individual written proposals or contracts. Those documents, once signed, take precedence over these general Terms for the work they cover.
Payment
Unless otherwise agreed in writing, invoices are due on receipt. A deposit may be required before work begins and is non-refundable. We may pause or suspend services for overdue accounts.
Intellectual Property
Upon full payment, you own the final deliverables created specifically for you. We retain ownership of our pre-existing tools, code libraries, frameworks, and processes, and we reserve the right to display completed work in our portfolio and marketing unless otherwise agreed in writing.
Third-Party Services
Our websites and services may rely on third-party providers (such as hosting, analytics, payment processing, and messaging platforms). We are not responsible for the availability, changes, or practices of those third parties.
Cancellation and Termination
Either party may terminate an engagement as provided in the governing agreement. Fees for work completed through the termination date are due, and deposits are non-refundable.
No Guarantee of Results
Our services are provided on an "as is" and "as available" basis. We do not guarantee specific outcomes such as search rankings, traffic levels, lead volume, sales, or review counts, which depend on factors outside our control.
Limitation of Liability
To the fullest extent permitted by law, Brooklyn Beach Design LLC is not liable for any indirect, incidental, special, or consequential damages. Our total liability for any claim is limited to the amount you paid us for the specific service giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless Brooklyn Beach Design LLC from any claims arising out of content or materials you provide, your use of our deliverables, or your violation of these Terms or applicable law.
Governing Law
These Terms are governed by the laws of the State of California. Any dispute will be resolved in the state or federal courts located in Riverside County, California.
